Virtex Apps, LLC (VIRTEX) values our users and guests and respects your concerns about online security and privacy. This Privacy Policy governs your use of all games, apps and other online services provided by VIRTEX and use of VIRTEX websites including www.virtexapps.com, www.chickencharge.com, and all linked pages owned and operated by VIRTEX (collectively, the “Products”). We believe in providing you with a safe and secure online experience. Our Privacy Policy is intended to provide you with information about how VIRTEX collects and handles personal information about you as you use the Products. By using the Products, you consent to the collection and use of your personal information as set forth herein.

This Privacy Policy is incorporated into the VIRTEX End User License Agreement (EULA) by this reference (www.virtexapps.com/eula) and the VIRTEX Website Terms of Use by this reference (www.virtexapps/tou). In addition to reviewing our Privacy Policy, you should also read the EULA and Website Terms of Use. Your use of the Products constitutes your agreement to the terms of this Privacy Policy.

Our Privacy Policy Will Change Over Time
Because we continue to develop the Products and take advantage of technologies to improve the services we provide, our policies will change over time. We encourage you to refer to this Privacy Policy from time to time to stay abreast of our most current privacy policy practices. While we may attempt to notify users of any material changes in the Privacy Policy by posting a notice on our website, it is your responsibility to check for updates to the Privacy Policy and any such update shall be effective even if you do not receive notice of such update. If you do not consent to the updated Privacy Policy, you can discontinue use of the Products. Your continued access and use of the Products will constitute your acceptance of any changes or revisions to our Privacy Policy.

What is Personal Information?
Personal information is information that specifically identifies an individual, such as a name, address, telephone number, email address, or other account number, and information about that individual’s activities when directly linked to that person, such as information about his or her use of the Products. Personal information also includes demographic information, such as date of birth, gender, geographic location and preferences when such information is linked to other personal information that identifies you. Personal information does not include “aggregate” information. Aggregate information is data we collect about a group or category of products, services or customers, from which individual customer identities have been removed. In other words, information about how you use the Products may be collected and combined with information about how others use the same Products. Aggregate data helps us understand trends and our users’ needs so that we can better consider new features or otherwise tailor the Products.

Personal Information We Collect
We collect limited personal information in a number of ways when you use the Products. For example, we collect personal information when you: (1) contact us by email or otherwise, (2) interact with us on social media channels, or (3) download a Product from or otherwise interact with the Apple App Store, Google Play and other app marketplaces where we make our Products available (the “Marketplaces”). We also may collect information on how you use or interact with our Products. Further, when you access the Products, some information is also automatically collected, such as your computer’s Internet Protocol (IP) address, your mobile device id, your computer’s operating system, the browser type, the address of a referring website, and the time and date of your visit.

Other Information We Collect, including Cookies, IP Addresses and URLs
We automatically receive certain types of information whenever you interact with us. For example, when you use the Products, we automatically collect your IP address and the type of browser you use. Additionally, the Products incorporate the AdMob advertising platform from Google. AdMob uses the DoubleClick cookie to serve ads displayed within the Product. Google’s use of the DoubleClick cookie enables it and its partners to serve ads to you based on your usage of the Product and/or other apps or Internet sites. You may opt out of the use of the DoubleClick cookie for interest-based advertising by visiting Ads Settings (www.google.com/ads/preferences). Alternatively, you may opt out of a third-party vendor’s use of cookies for interest based advertising by visiting aboutads.info.

How VIRTEX Uses and Shares Information About You
We currently collect contact information only when you choose to interact with us through email or social media. When you submit information through our social media channels (for example, by providing a testimonial about one of our Products) we may publish the information you submitted, alongside your name. We do not disclose your personal information to unaffiliated third parties unless you have requested or authorized us to do so.

VIRTEX may use software tools to measure and analyze usage of VIRTEX’s Products. The analyzed information includes data such as how often the Products are used and how users interact with interfaces. This helps us better understand how our Products are utilized and enables us to prioritize improvements. Such information is generally presented in an aggregate form and typically cannot be used to identify individuals.

Sharing of Your Information in Other Circumstances
If we have any personal information about you, we may disclose such personal information to comply with legal process or authorities, respond to any claims, or to protect the rights, property or personal safety of VIRTEX, our users, our employees or the public. In addition, information about our users, including personal information, may be disclosed or transferred as part of, or during negotiations of, any merger, sale of company assets or acquisition. Please note that because a customer information database is customarily considered a business asset, VIRTEX reserves the right to transfer the database in a merger or sale of some or all of its company or in an action for bankruptcy. Your information will continue to be treated in accordance with this Privacy Policy by the acquiring or merged company unless you are notified and provided an opportunity to change your preferences.

Third Party Services
Information regarding usage of the game, including but not limited to downloads and game execution, is collected and secured by third-party distributors, such as Google Play. VIRTEX has no control over how third parties handle your information. Additionally, you may access other third party services, such as YouTube and other social media websites and Marketplaces (“Third Party Services”), through the Products. Some Third Party Services may also provide us with information from your accounts to enhance and personalize your use of the Products. You understand that where you allow our Products to interact with any Third Party Service, we and the Third Party Service may share data about you. We will share data in accordance with this Privacy Policy. We have no control over how Third Party Services will handle data.

Data Security
Information regarding usage of Virtex Apps Websites, including but not limited to visitor IP addresses and browser types, is collected and secured by the website host, DreamHost. Contact information that website visitors choose to email to VIRTEX is not secure. Information gathered by social network partners would be collected and secured by those partners. Access to such data is governed by their Privacy Policies available on their respective websites.

Use of the Products by Minors
Parents and guardians should monitor the use of the Products by minor children (under the age of 18). Children under age 13 should not use the Products at all. If a child under age 13 submits information through any Product, and we become aware that the person submitting the information is under age 13, we will attempt to delete the information as soon as reasonably possible.

Links to Other Websites
The Products may contain links to other websites. Any personal information you provide on the linked pages is provided directly to that third party and is subject to that third party’s privacy policy. Except as described above, we are not responsible for the content or privacy and security practices and policies of websites to which we link. Links from the Products to third parties or to other sites are provided for your convenience. We encourage you to learn about their privacy and security practices and policies before providing them with personal information.

This Privacy Policy Applies To United States Customers
VIRTEX is based in the United States. This Privacy Policy is intended to comply with privacy laws in the United States and may not comply with all privacy laws in foreign countries. If you are a non-US user of the Products, by using the Products and providing us with data, you acknowledge, agree and provide your consent that your personal information may be processed in the United States for the purposes identified in this Privacy Policy. In addition, such data may be stored on servers located outside your resident jurisdiction, which may have less stringent privacy practices than your own. By using the Products and providing us with your data, you consent to the transfer of such data and any less stringent privacy practices.

Product Development
THE PRODUCTS ARE UNDER CONTINUOUS DEVELOPMENT AND TESTING. THE PRODUCTS MAY CONTAIN BUGS AND OTHER ERRORS THAT COULD ADVERSELY AFFECT THE USE OR PERFORMANCE OF THE PRODUCTS. ANY ISSUES OR ERRORS OF THIS NATURE MAY IMPACT OUR ABILITY TO COMPLY WITH THIS PRIVACY POLICY.
